Practice Pointers for Effectively Utilizing Motion Practice in the First and Second Department of the Appellate Division; Part I of a Series.
 
This Appeals CLE will provide an in-depth discussion concerning motion practice within the First and Second Departments of the New York State Appellate Division. The presenters will describe different types of motion practice and useful strategies that parties may consider to successfully dismiss an appeal before an appellant or cross-appellant perfects, which could save a client’s money and time. The panel will also discuss motions for emergency relief, such as seeking a stay, motions related to an incomplete or overbroad record, motions to dismiss based upon procedural irregularities or orders that are not appealable, and motions to reargue and for leave to appeal to the Court of Appeals. The program will also address the technicalities associated with interlocutory appeals, such as the doctrines commonly referred to as Matter of Aho and Bray v. Cox.  Additionally, the panel will explain the different rules within the First and Second Departments when seeking extensions of time to perfect and to file a respondent’s brief and reply briefs.  Finally, the presenters will conclude by briefly discussing practical tips in a question/answer format.
